Notice is hereby given that Floresville Independent School District intends to examine alternatives to its present food service program.  All interested parties may attend a Pre-proposal Conference and District Tour on April 9, 2008 from 10:00 a.m. to 2:00 p.m. at 908 10th Street in Floresville.

No offer of intent should be construed from this legal notice that Floresville Independent School District intends to enter into a contract with any party for alternative food service unless, in the sole opinion of District, it is in District’s best interest to do so.

All costs involved in submitting alternatives to Floresville Independent School District's current food service program shall be borne in full by the interested party and should be kept to a minimum.  A copy of the Request for Proposal can be obtained by contacting:

Floresville Independent School District reserves the right to accept any proposal which it deems most favorable to the interest of District and to reject any or all proposals or any portion of any proposal submitted which, in District’s opinion, is not in the best interest of District.

FOOD SERVICE MANAGEMENT SERVICES

PROPOSALS DUE:  April 14, 2008 2:00p.m.

INSTRUCTIONS TO VENDORS

1.   At any time prior to the specified time and date set for proposal opening, Proposer (or an authorized representative) may withdraw a submitted proposal by submitting a request in writing.  

2.   Proposer or authorized representative must agree to the Request for Proposal criteria and attached specifications and indicate their concurrence by executing the agreement on page six herein and returning it with the proposal package. 

3.       A person authorized to sign the proposal must initial erasures, notes or other modifications in the proposals. 

4.        All proposals shall include the completed forms provided in this proposal invitation package. It is permissible to copy these forms, if necessary. 

5.   In order to ensure objective contractor performance and eliminate unfair competitive advantage,

any vendor or vendor employee that develops or drafts proposal criteria or specifications, requirements, statements of work, invitations for bids, requests for proposals, contract terms and conditions or other documents for use by District in conducting this procurement shall be excluded from competing for this procurement.  This provision shall not prevent an FSMC from suggesting language for inclusion in LEA’s contract as part of its proposal or in the course of negotiation of contract language following completion of the RFP process and selection of FSMC as the vendor, so long as it is not inconsistent with and does not materially or substantially change the terms and conditions of the RFP, accepted Proposal and the Texas Standard Food Service Management Company Contract.   

6.   Two copies of the sealed proposals are to be in District office no later than 2:00 p.m. and shall be addressed to:

7.   Late proposals will not be considered and will be returned unopened to the appropriate

      company.  

8.   No proposal may be altered, amended or withdrawn after the specified time for opening 

      proposals.  

9.   Periods of time, stated as number of days, shall be calendar days.   

10. It is the responsibility of Proposer to examine the entire proposal package, seek clarification of any item or requirement that may    not be clear, and check all responses for accuracy 

      before submitting a response. 

11. Awards shall be made with reasonable promptness to the Proposer whose proposal best 

      conforms to the invitation and will be the most advantageous to Floresville Independent School

      District.  Award(s) may be made to other than the low price Proposer.  

 

12. Floresville Independent School District Board of Trustees, notwithstanding any other

      provision of this Request for Proposal (including all attached documents), expressly reserves

      the right to:  

·         Waive any insignificant defect or informality in any proposal procedure. 

·         Reject any or all proposals. 

·         Reissue a Request for Proposal

13. A proposal in response to a Request for Proposal is an offer to contract with Floresville

Independent School District based upon the terms, conditions and specifications set forth in the Request for Proposal and Proposer’s proposal, so long as proposal terms, conditions and specifications are not inconsistent with and do not materially or substantially change the terms and conditions of the RFP.  The contract shall conform to the Texas Standard Food Service Management Contract, which is attached to this RFP as “Exhibit I”and fully incorporated herein.

 

REQUEST FOR PROPOSAL

Proposals will be received until 2:00 p.m. on April 14, 2008 for supplying Floresville Independent School District with food service management services during the school year of 2008-2009, with options for renewal of the contract for four additional terms of one year each.

District will only consider cost-reimbursable proposals.  District will not consider meal-rate or fixed-rate proposals.

Sealed proposals are subject to all the conditions and specifications attached hereto and will be received in the office of Floresville and shall be marked on the envelope "Proposal for Food Service Management."

In accepting proposals, Floresville Independent School District reserves the right to reject any and all proposals and to waive any minor informalities in order to take the action which it deems to be in the best interest of District.

Proposers must submit a complete response to the Request for Proposal, including all certifications, in order to provide a responsive bid.

Contracts entered into on a basis of submitted proposals are revocable if contrary to law.
